乘客坐车若不系安全带警察会罚司机吗？

I have questions about seat belt that no friend can answer me even Canadian.Is it mandatory for passengers in back seats to wear seat belts all the time?If yes，is it the responsibilities of driver to remind passengers to wear seat belt?If the passenger refuses to wear seat belt and he/she does not have driver's license，will the police officer issue a ticket to the driver or the passenger?

这个话题很重要，每一次我在听交通消息，听到哪个地方发生重大交通事故，然后有人因为没系汽车安全带而死亡，我都会在想，如果那个人当时系好了汽车安全带，也许他/她还活着。 每次听到这种消息总是很痛心，很可惜。我始终坚持认为汽车安全带是会救命的。那么，安省交通法关于汽车安全带又是如何规定的呢？

首先来看看安省交通法第106条的规定：

Use of seat belt assembly by driver106(2) Every person who drives on a highway a motor vehicle in which a seat belt assembly is provided for the driver shall wear the complete seat belt assembly as required。

这里说的很清楚，如果汽车有安全带的话，所有的汽车司机在公路上开车的时候都要系好安全带。

Use of seat belt assembly by passenger106(3) Every person who is at least 16 years old and is a passenger in a motor vehicle on a highway shall,(b) wear the complete seat belt assembly as required。

这里说的是所有的乘客年纪在16岁以上，都必须要系好安全带，不管你是坐在汽车的前面还是后面。如果被警察停下来的话，警察可以给乘客开交通罚单。乘客必须提供他/她的姓名，出生日期和住址，不管乘客有没有驾照。可以这么说，如果乘客的年纪在16岁以上，那么是乘客自己的责任去系好安全带。

Driver to ensure young passenger uses seat belt assembly106(4) No person shall drive on a highway a motor vehicle in which there is a passenger who is under 16 years old unless,That passenger,(ii) is wearing the complete seat belt assembly as required.that passenger is required by the regulations to be secured by a child seating system or child restraint system，and is so secured.

这里说的是如果乘客在16岁以下，那么是司机的责任要让乘客系好安全带。如果被警察停下来并要开交通罚单的话，那么警察只会给司机开这张罚单，而不是给乘客。另外，如果乘客是小孩的话，那么按照安省的有关规定，司机必须使用符合规定的小孩座椅来确保小孩的安全。如果违法的话，汽车司机有可能被开交通罚单。有关规定，请参考安省第613条的说明。

当然啦，这条法律也有例外。如果你的医生给你开了证明说明你不适合系安全带的话，那么你就可以免责了. 详细的有关规定还请参考交通法第106条。我们现在知道了在开车的时候必须要系好安全带，那么如何才算是系好呢？

安省交通法对此也有规定：

How to wear seat belt assembly106(5) A seat belt assembly shall be worn so that,(a) the pelvic restraint is worn firmly against the body and across the hips;(b) the torso restraint，if there is one，is worn closely against the body and over the shoulder and across the chest;(c) the pelvic restraint，and the torso restraint，if there is one，are securely fastened; and(d) no more than one person is wearing the seat belt assembly at any one time.

简单的说，安全带使你的肩膀，胸部和大腿够成三角形就可以了。 请参考汽车安全带的详细说明。我们平时开车的时候经常可以看到有些人是坐在安全带上的，而不是系在安全带上的。还有一些人把安全带放在腋窝底下，这些做法都是违规的。如果汽车发生碰撞，这时候安全带就起不到应有的作用。

总体来说，请大家记住以下几点：

司机在公路上开车要系好安全带汽车里的所有乘客都要系好安全带，16岁以上的乘客是乘客自己的责任，16岁以下的乘客是司机的责任安全带使你的肩膀，胸部和大腿够成三角形才算是系好了最后，就是让大家知道一个道理，汽车安全带是能够救命的。
