没人说试用期不能解雇,而是说,必须要有合法程序手续,必须给出辞退理由.

When can an employee's job be terminated?
In most cases, an employer can terminate an employee's job at any time, but employers must provide proper written notice, or termination pay instead of notice .
However, there are some situations where an employer can't terminate an employee's employment even if the employer is prepared to give proper written notice or termination pay. For example, an employer can't end someone's employment, or penalize them in any way, if any part of the reason for the termination of employment is based on the employee asking questions about the ESA or exercising a right under the ESA , such as refusing to work in excess of the daily or weekly hours of work maximums, or taking a pregnancy, parental, personal emergency, declared emergency or family medical leave. Do all employees qualify for termination notice and pay?
Certain employees are not entitled to notice of termination or termination pay under the ESA . For example, employees who are guilty of wilful misconduct, disobedience or wilful neglect of duty that isn't trivial, and has not been condoned by the employer, are not entitled. Other examples include construction employees, employees on temporary layoff and employees who refuse an offer of reasonable alternative employment.
An employee who has been employed less than three months and has his or her employment terminated is not entitled under the ESA to notice of termination or termination pay.
Many of the exemptions from the ESA are complex. Contact the Ministry of Labour for further information.
Apparently, the only requirement is a written notice or termination pay.

The reason for probation is to test whether the person is a good fit to the position or the person has the abilities he or she claims to deliver the duties. If we can't terminate someone on probation, what's probation for?

我当管工(SUPER)时遇到此类情况通常是要求班组长写一个报告,
理由可能很荒唐,比方他0001901202.然后我拿着着辞退通知并写明辞退理由.如果对方有异议,我直接告诉对方,你的同事不喜欢你.就那么简单.
但是必须具备正常辞退手续,班组签字和我本人签字并报公司人事部门存档.
不可以在试用期间无理由辞退,那不符合劳工权益法的.

I don't know whether it is against human rights not to give the reason of termination.
I was trained not to give reasons. We would tell the staff you are not a good fit to the position or you are no longer with the company. Period.
If the staff is not satisfied with the amount in the cheque, go sue us. We always have our lawyer standing by.
If the staff makes a nuisance, call police. After termination, the staff cannot return to the company without permission. The company is the employer's property. After all, would you allow your ex-wife after divorce to return to your home? Definitely not.
