However, you probably would sign buyer customer agreement which just involves with this specific property rather than Buyer agency agreement(appoint that agent to be your exclusive agent for certain period)

如果你对你的代理不满意,比如他或者她不能带你看房,不为你的利益着想,你可以向他的公司或者多论多地产局投诉,并且要求解除合同,假如经纪真的有违犯职业操守的地方,虽然你不一定能追后什么损失,至少能把合同解除. 另外,你和经纪签合同之前,经纪需要问你是否还在另一个合同期内,如果是,经纪是的话,经纪是不能和你再签的. 其实这个CASE可能没有说清楚全部过程,所以大家也不能完全知道到底是怎么回事. 权利和责任都是双方的,你不能签了合同就一走了之,经纪更不能签了合同后不全心全意为你服务.

If the commission is the same on both listing agreements and the buyer was NOT introduced to the property by salesperson A, then salesperson A does not get anything. If the commission was lower on the second, AND the buyer was introduced to the property during the agreement with Salesperson A, then the seller owes Salesperson A the difference between the two commission rates. - the sale was made during the holdover period. yes, I am very familiar with OREA code of Ethics despite that I am not in practice now, thank you. 后文中讲得很清楚: 如果,她所看中的住房,原经纪人并未介绍给她看过,她并无补偿原经纪人的义务;如她所看中的住房,是原经纪人介绍过的,她需要支付给原经纪人的仅是前后经纪人佣金的差额。 两种可能性都有。如果对方经纪人曾经带她看过这套房子(尽管未购买),进入HOLDOVER PERIOD后成交,是会有法律问题的。如果没有看过,则无补偿义务。

最初由 KUIPORNG 发布: NOT THE SAME property looks like the lady didn't buy the same property (didn't say that in the original document)... so there is no legal problem then.... if it is the same property... for sure she will have legal problem... actually it doesn't matter. Once you signed Buyer agreement contact, you are obligated to deal with the same agent for that time period. It only exists in Chinese agents that some of them don't need you to sign the agreement before you put your offer.

具体来讲,对与买家而言,如果你在代理合同的一般有效期内,通过经纪人A的介绍,去看过一套住房,但没有购买。而在代理合同一般有效期结束,进入合同延伸期后,通过私售,或者其它经纪人(如经纪人B)的代理而购买了该套住房。这时,该买家需补偿其原经纪人(即经纪人A)。其补偿额度的大小,视具体情况不同而不同,可能是全额买方经纪费(如最后通过私售成交),也可能是买方经纪费的一部分。 Something wrong here. In the hold-over period(usually 60 to 90 days), if you bought or sold your property by yourself, you need to amend agency fees to the agent. However, if in the holdover period, if you find Agent B to represent you, Agent A has no right to claim agent fee any more. Although that doesn't apply to this case since it is still within the contact when that lady contaced the second agent but people should know that right after the contact, they have right to find another agent.

I won't pay any commission to my agents, the commission will be paid by the seller. So, the buyer won't care what's the difference between 2 or 3 agents. If the previous buyer's agent wants any commission, she/he must ask thew seller.
