Officer in fatal accident involved in airport Taser death

METRO VANCOUVER - One of the four RCMP officers involved in the Tasering of Polish immigrant Robert Dziekanski is facing charges of impaired driving causing death after a collision in Delta Saturday night.
However, Delta police - who are investigating the crash - have refused to identify the officer until he makes his first court appearance on Jan. 15 and is formally charged.
Orion Hutchinson, 21, was riding westbound on his motorcycle along Sixth Avenue around 10:20 p.m. Saturday when his bike collided with an east-bound Jeep at the intersection of Gilchrist.
Hutchinson, who was thrown from his bike, suffered traumatic injuries and was pronounced dead at the scene.
The driver of the Jeep, an RCMP member, was transported to Delta police headquarters where, according to Delta police, he failed a breathalyser test.
The officer was released on a promise to appear in Surrey Provincial Court on Jan. 15, 2009.
Delta police say they expect the officer to be charged on that date with impaired driving causing death and driving over the legal limit, though he could also face additional charges.
Delta police spokesman Const. Paul Eisenzimmer said police decided not to hold the officer in custody because he wasn't considered a flight risk.
"He's got no prior record," said Eisenzimmer. "So there was no reason to believe he wouldn't attend court."
However, the decision by Delta police to release the officer also means his name could remain secret for months.
That's because if he had been held in custody, he would have appeared before a judge or Justice of the Peace and the charges against him formally sworn - meaning police would have no reason not to release his name.
Eisenzimmer denied the officer received special treatment.
"He hasn't been dealt with any differently," he said. "He got the same treatment as anyone else with that kind of background would have. ... If there had been reason to hold him, he would have been held."
Eisenzimmer refused to release further details about the crash - including how much the officer was allegedly over the legal limit - because the case is still under investigation.
While the officer's name has not been released, RCMP spokesman Sgt. Tim Shields confirmed Tuesday the officer is one of the four who was involved in the Tasering of Dziekanski on Oct. 14, 2007.
Dziekanski died shortly after being Tasered.
The Integrated Homicide Investigation Team concluded its investigation into Dziekanski's death in June and Crown prosecutors are still reviewing whether to lay criminal charges against the officers involved.
Shields said the officer involved in Saturday's crash has been suspended with pay for now, though the RCMP Commissioner could decide at a later date to withhold his salary.
Before being suspended, said Shields, the officer was working for the RCMP's Vancouver 2010 Integrated Security Unit.
Shields said the RCMP "is sick about" the crash and offered its condolences to the Hutchinson family.
Reached by phone at their Tsawwassen home, Hutchinson's family declined to comment.

Mountie will be tried on impaired driving charges: RCMP
A North Vancouver Mountie was ordered to stand trial on two drunk driving charges at a recent court appearance, an RCMP spokeswoman said Friday.
Const. Annie Linteau released the information after media questions about the number of RCMP officers facing drunk driving charges following a fatal collision involving an off-duty Mountie in Delta, B.C., last weekend.
"Cpl. Darren Baker … was stopped on Dec. 15 in West Vancouver by members of the West Vancouver Police Department. While dealing with Cpl. Baker, they formed the opinion that his ability to drive a motor vehicle was impaired by alcohol," Linteau told CBC News.
The vehicle was being driven erratically by the off-duty officer, she said.
"The driver provided two samples of his breath and was served an appearance notice," Linteau said. "He has made a first court appearance. The matter is set for trial on Jan. 27, 2009."
Baker has been charged with impaired driving and driving with a blood alcohol level above .08.
Linteau said the RCMP also conducted a code of conduct investigation against Baker, who belonged to a school liaison unit, but has since been placed in administrative duties. He will face a disciplinary hearing on Feb. 25 and 26, she said.
2 other Lower Mainland cops accused of impaired driving
Following the fatal crash in Delta, Cpl. Benjamin Montgomery Robinson, 38, was given a breathalyzer and Delta police have recommended he be charged with impaired driving causing death. He is scheduled to appear in provincial court on Jan. 15.
Last Saturday night, Orion Hutchinson, 21, was killed in the Delta community of Tsawwassen, when a Jeep collided with the motorcycle he was riding.
The driver of the Jeep left the scene, but shortly after the crash police arrested Robinson, a member of the RCMP's Vancouver 2010 integrated security unit, who was off duty at the time.
A female officer with the New Westminster Police Service is also facing a charge of impaired driving following a single-vehicle accident nearly two weeks ago in North Vancouver.
Const.Tomi Hamner, 47, was off duty on Oct. 18 and was driving an unmarked police vehicle when it struck a sign on Highway 1 near Westview Drive.
Hamner was released on a promise to appear in North Vancouver Provincial Court on Dec. 17.
