调查显示:90%受访者反对Bill 13法案

5月15日,家庭价值联盟在世纪皇宫酒店召开新闻发布会,公布了由该组织最近在大多伦多地区范围进行的有关Bill 13法案民意调查。100多位社区人士到场,表达对Bill 13法案的反对民意。家庭价值联盟召集人陈嘉年表示,此次民意调查收集到2800多个回复,结果显示,有超过90%接受调查人士反对此案,根据大家的意见,联盟现向安省政府提供以下意见:

1.不要通过Bill 13.一定有其它更好的平等法案去针对饭欺凌问题。
2.不可在学校强制推行(同性-异性联合学生会)。
3. 不可向幼少学生推行性教育,性教育课从中学开始。
4.地区教育局及学校对性取向课程有自主权。
5.向学生推行传统家庭价值教育。
6.应立即由各省议员在其选区全面深入咨询公众,以确保反欺凌法案能真正公平保护所有学生。
7.Bill13应由全民投票决定是否通过。

调查显示,针对草案中提出的部分条款,99.1%被访者反对学校要求三年级及以上的学生参加以同性取向为荣的游行支持反欺凌行动;95.4%对13号草案中拟对4岁及以上年龄学生灌输性教育知识表示反对;84.8%反对在学校设有《同性——异性取向联盟》。另有58.25%被访者表示其选区内的省议员未曾对该草案进行公众咨询。

新闻发布会主持人徐振伟表示,之所以反对13号议案,是因为它侮辱家长的选择、教育委员的权利、教师的职责、宗教自由、保守的价值观、教育的基本原则,以及对非成熟儿童正常的身心发展和族裔价值观缺乏应有的尊重。

据徐振伟介绍,安省自由党政府要通过13号议案,强制执行在幼稚园对四岁以上儿童进行性知识教育。自由党政府下一步更糟糕,提议立法要所有公立和天主教学校,引导三年级以上学生推动和实行《同性性取向联盟》游行和组织。最后,所有性活动和六种性别:女同性恋、男同性恋、双性恋、变性人、怪异者或怀疑自己性取向者、双性魂都会包括在教育活动课程内。因此,有同性恋倾向的人可以利用这机会,引诱孩子们成立组织,举办同性恋游行,学校当局将无法拒绝,反而要提供设施和支持。最后,任何性取向指导课程都可以成为学校课程和活动,而家长则不可能说“不”,或者阻止他们的孩子参加这些课程及活动。

徐振伟说,请不要受自由党政府误导,把《同性性取向联盟》包括在反欺凌里面。其实,反欺凌和《同性性取向联盟》是两个不同的议题,不应放在同一的13号议案。我们有保护我们孩子的权利。还有,必须尊重父母和任何人个别选择权利。政府没权强迫我们的孩子去认同、参与学校里面这些《同性性取向联盟》的生活方式。

徐振伟说,我们不会歧视,打压或迫害同性恋,或多种性倾向的人。但我们要求有公平的选择,为我们的孩子选择接受或不接受某些并非基本道德和一般通识教育,有异于常情的生活行为。

据了解,13号草案是去年11月由安省自由党政府提出,很快保守党议员又提出14号私人草案,两个法案同样以「反校园欺凌」为主题,但后者更重反欺凌的技术性实施方案,避开了13号草案中性取向教育及特别保护同性恋学生的条款。两个草案现在都通过二读,等待最后三读的阶段。

Preamble The people of Ontario and the Legislative Assembly: Believe that education plays a critical role in preparingyoung people to grow up as productive, contributing andconstructive citizens in the diverse society of Ontario; Believe that all students should feel safe at school anddeserve a positive school climate that is inclusive andaccepting, regardless of race, ancestry, place of origin, colour, ethnic origin, citizenship, creed, sex, sexual orien- tation, age, marital status, family status or disability; Believe that a healthy, safe and inclusive learning envi- ronment where all students feel accepted is a necessarycondition for student success; Understand that students cannot be expected to reach theirfull potential in an environment where they feel insecureor intimidated; Believe that students need to be equipped with the knowl- edge, skills, attitude and values to engage the world andothers critically, which means developing a critical con- sciousness that allows them to take action on making theirschools and communities more equitable and inclusive forall people, including LGBTTIQ (lesbian, gay, bisexual, transgendered, transsexual, two-spirited, intersexed, queer and questioning) people; Recognize that a whole-school approach is required, andthat everyone — government, educators, school staff, parents, students and the wider community —has a role to play in creating a positive school climate and prevent- ing inappropriate behaviour, such as bullying, sexual as- sault, gender-based violence and incidents based on ho- mophobia; Acknowledge that there is a need for stronger action tocreate a safe and inclusive environment in all schools, andto support all students, including both students who are impacted by and students who have engaged in inappro- priate behavior, to assist them in developing healthy rela- tionships, making good choices, continuing their learningand achieving success. Therefore, Her Majesty, by and with the advice and con- sent of the Legislative Assembly of the Province of On- tario, enacts as follows: 1. (1) Subsection 1 (1) of the Education Actisamended by adding the following definition: “bullying” means repeated and aggressive behaviour by apupil where, 👼 the behaviour is intended by the pupil to cause, orthe pupil ought to know that the behaviour wouldbe likely to cause, harm, fear or distress to anotherindividual, including psychological harm or harmto the individual’s reputation, and 🍺 the behaviour occurs in a context where there is areal or perceived power imbalance between the pu- pil and the individual based on factors such as size, strength, age, intelligence, peer group power, eco- nomic status, social status, religion, ethnic origin, sexual orientation, family circumstances, gender, race, disability or the receipt of special education; (“intimidation”) (2) Section 1 of the Act is amended by adding thefollowing subsection: Bullying (1.0.0.1) For the purposes of the definition of “bully- ing” in subsection (1), behaviour includes the use of anyphysical, verbal, electronic, written or other means. 2. (1) Paragraph 29.1 of subsection 8 (1) of the Actis repealed and the following substituted: equity and inclusive education 29.1 require boards to develop and implement an equityand inclusive education policy, and, if required bythe Minister, submit the policy to the Minister andimplement changes to the policy as directed by theMinister; (2) Subsection 8 (1) of the Act is amended by addingthe following paragraph: surveys under s. 169.1 (2.1) 31. establish policies and guidelines respecting thesurveys referred to in subsection 169.1 (2.1); 3. (1) Subsection 169.1 (1) of the Act is amended byadding the following clauses: (a.1) promote a positive school climate that is inclusiveand accepting of all pupils, including pupils of anyrace, ancestry, place of origin, colour, ethnic ori- gin, citizenship, creed, sex, sexual orientation, age, marital status, family status or disability; (a.2) promote the prevention of bullying; (2) Section 169.1 of the Act is amended by addingthe following subsections: School climate surveys (2.1) In fulfilling its duties under clause (1) 📩 withrespect to the effectiveness of policies developed by theboard to promote the goals referred to in clauses (1) (a.1) and (a.2), every board shall use surveys to collect infor- mation from its pupils at least once every two years inaccordance with any policies and guidelines made underparagraph 31 of subsection 8 (1). Same (2.2) In collecting information from pupils under sub- section (2.1), a board shall not collect any name or anyidentifying number, symbol or other particular assigned toa pupil. 4. The Act is amended by adding the following sec- tion: Purpose 300.0.1 The purposes of this Part include the follow- ing: 1. To create schools in Ontario that are safe, inclusiveand accepting of all pupils. 2. To encourage a positive school climate and preventinappropriate behaviour, including bullying, sexualassault, gender-based violence and incidents basedon homophobia. 3. To address inappropriate pupil behaviour and pro- mote early intervention. 4. To provide support to pupils who are impacted byinappropriate behaviour of other pupils. 5. To establish disciplinary approaches that promotepositive behaviour and use measures that includeappropriate consequences and supports for pupilsto address inappropriate behaviour. 6. To provide pupils with a safe learning environ- ment. 5. The Act is amended by adding the following sec- tion: Bullying Awareness and Prevention Week 300.0.2 (1) The week beginning on the third Sundayin November in each year is proclaimed as BullyingAwareness and Prevention Week. Same, purpose (2) The purpose of subsection (1) is to promote aware- ness and understanding of bullying and its consequencesin the school community. 6. (1) Section 300.2 of the Act is amended by strik- ing out “as soon as reasonably possible”. (2) Section 300.2 of the Act is amended by addingthe following subsection: Same (2) An employee shall report to the principal as soon asreasonably possible or, if a different time period is speci- fied by the policies or guidelines, within that time period. 7. (1) Subsection 301 (2) of the Act is amended byadding the following paragraph: 7. To prevent bullying in schools. (2) Section 301 of the Act is amended by adding thefollowing subsection: Agreements with third parties re use of schools (3.1) If a board enters into an agreement with anotherperson or entity, other than a board, respecting the use ofa school operated by the board, the board shall include inthe agreement a requirement that the person or entity fol- low standards that are consistent with the code of conduct. (3) Subsection 301 👿 of the Act is repealed and thefollowing substituted: Same, governing discipline 👿 The Minister may establish policies and guidelineswith respect to disciplining pupils, including policies andguidelines respecting, 👼 the use of disciplinary measures within a frame- work that, 💡 identifies pupil behaviours that are inappro- priate and that, without excluding less seriousbehaviour, include bullying, sexual assault, gender-based violence and incidents based onhomophobia, (ii) provides for appropriate consequences forpupils who engage in inappropriate behaviour, (iii) provides for progressively more serious con- sequences for repeated or more serious inap- propriate behaviour, (iv) provides support for pupils who are impactedby inappropriate behaviour, and for pupilswho engage in inappropriate behaviour, to as- sist them in developing healthy relationships, making good choices, continuing their learn- ing and achieving success, (v) provides for prevention strategies, and (vi) provides for early and ongoing interventionstrategies; 🍺 opportunities for all pupils, their parents andguardians, and all teachers and other staff membersin a school to increase their understanding andawareness of inappropriate pupil behaviour; ☕️ opportunities for all teachers and other staff mem- bers in a school to increase their ability to respondto inappropriate pupil behaviour; training for all teachers and other staff; 📩 procedures for responding appropriately and in atimely manner to inappropriate behaviour; 🌹 resources to support pupils who are impacted byinappropriate behaviour; 🎁 resources to support pupils who have engaged ininappropriate behaviour; 😎 a process that parents or guardians of pupils de- scribed in clause 🌹 or 🎁 can follow if they haveconcerns about the support provided to their child. (4) Section 301 of the Act is amended by adding thefollowing subsections: Same, bullying (7.1) The Minister may establish policies and guide- lines with respect to bullying prevention and interventionin schools, including policies and guidelines respecting, 👼 training for all teachers and other staff; 🍺 resources to support pupils who are impacted bybullying; ☕️ the resources provided, as part of programs de- scribed in section 312, to pupils who have beensuspended or expelled for bullying; procedures that allow pupils to report incidents ofbullying safely and in a way that minimizes thepossibility of reprisal; 📩 the use of disciplinary measures within the frame- work described in clause 👿 👼 in response to bul- lying; 🌹 procedures for responding appropriately and in atimely manner to bullying. . . . . . Approval and changes, board policies and guidelines (11) The Minister may require boards to submit anypolicy or guideline established under section302 to the Minister and to implement changes to the policy or guide- line as directed by the Minister. 8. (1) Subsection 302 (2) of the Act is repealed andthe following substituted: Same, governing discipline (2) Every board shall establish policies and guidelines with respect to disciplining pupils, and the policies andguidelines must, 👼 be consistent with this Part and with those estab- lished by the Minister under section 301; 🍺 address every matter described in clauses 301 👿 👼 to 😎; and ☕️ address any other matter and include any otherrequirement that the Minister may specify. (2) Section 302 of the Act is amended by adding thefollowing subsection: Same, governing bullying (3.4) Every board shall establish policies and guide- lines with respect to bullying prevention and interventionin schools, and the policies and guidelines must, 👼 be consistent with those established by the Ministerunder section 301; 🍺 address every matter described in clauses 301 (7.1) 👼 to 🌹; and ☕️ address any other matter and include any otherrequirement that the Minister may specify. 9. The Act is amended by adding the following sec- tion: Board support for certain pupil activities and organizations 303.1 Every board shall support pupils who want toestablish and lead, 👼 activities or organizations that promote gender eq- uity; 🍺 activities or organizations that promote anti-racism; ☕️ activities or organizations that promote the aware- ness and understanding of, and respect for, peoplewith disabilities; or activities or organizations that promote the aware- ness and understanding of, and respect for, peopleof all sexual orientations and gender identities, in- cluding organizations with the name gay-straight alliance or another name. 10. Subsection 310 (1) of the Act is amended byadding the following paragraphs: 7.1 Bullying, if, i. the pupil has previously been suspended forengaging in bullying, and ii. the pupil’s continuing presence in the schoolcreates an unacceptable risk to the safety ofanother person. 7.2 Any activity listed in subsection 306 (1) that ismotivated by bias, prejudice or hate based on race, national or ethnic origin, language, colour, religion, sex, age, mental or physical disability, sexual ori- entation, or any other similar factor. Commencement 11. (1) Subject to subsection (2), this Act comes intoforce on September 1, 2012. Same (2) Section 5 comes into force on the day this Actreceives Royal Assent. Short title 12. The short title of this Act is the Accepting Schools Act, 2011.

This section is amended toinclude the following goals: promoting a positive schoolclimate that is inclusive and accepting of all pupils andpromoting the prevention of bullying. Boards are re- quired to use surveys to monitor and evaluate the effec- tiveness of the boards’ policies relating to these newgoals. 3. A new section 300.0.1 sets out the purposes of Part XIIIof the Act (Behaviour, Discipline and Safety). 4. A new section 300.0.2 proclaims the third week in No- vember as Bullying Awareness and Prevention Week. 5. Subsection 301 (2) of the Act, which sets out the pur- poses of the provincial code of conduct, is amended toinclude preventing bullying in schools. A new subsec- tion 301 (3.1) requires boards that enter into an agree- ment with another person or entity respecting the use of a school operated by the board to require the person orentity to follow standards that are consistent with theprovincial code of conduct. Subsection 301 👿, whichauthorizes the Minister to make policies and guidelineswith respect to disciplining pupils, is amended to set outa list of matters that this power includes. A new subsec- tion 301 (7.1) authorizes the Minister to make policiesand guidelines with respect to bullying prevention andintervention in schools and sets out a list of matters that this power includes. 6. Subsection 302 (2) of the Act, which authorizes boardsto establish policies and guidelines with respect to disci- plining pupils, is amended to require boards to establishpolicies and guidelines that address the matters set out insubsection 301 👿. The new subsection 302 (3.4) re- quires boards to establish policies and guidelines withrespect to bullying prevention and intervention inschools that address the matters set out in subsection 301(7.1). 7. A new section 303.1 requires boards to support pupilswho want to establish and lead activities or organizationsthat promote gender equity, anti-racism, the awarenessand understanding of, and respect for, people with dis- abilities or the awareness and understanding of, and re- spect for, people of all sexual orientations and genderidentities. 8. Subsection 310 (1) of the Act, which sets out the cir- cumstances in which a pupil must be suspended andconsidered for possible expulsion, is amended to includecertain circumstances relating to bullying and to activi- ties that are motivated by bias, prejudice or hate.

一个多月前开始, 准备在省议会投票的安省13号法案里的强迫小学生学习同性恋课程就引起了不少抗议和反对, 中英文媒体上的调查都是大部分人反对这个霸王条款, 成了安省自由党的屎盆子. 当前法律并不禁止同性恋成立俱乐部. 你以为自由党会傻到13号法案里没有"强迫小学生学习同性恋课程"内容, 却故意保持沉默一直不"澄清事实"?

回复 5 past 6:既然这么多人反对强迫小学生学习同性恋课程, 而且相信是Bill 13法案的一部分, 怎么说都是个屎盆子吧? (除非你认为这是给自由党加分的好事), 那么多自由党的精英/顾问会一个多月不反驳? 你根本就不用花时间三读Bill 13法案还要翻译, 那些自由党人早就看过多少遍了, 不是他们干的坏事, 他们不会不愿出面否认的. 事实是麦坚迪一直不肯公开宣布Bill 13法案绝没有任何"强迫小学生学习同性恋课程"的东西, 就跟他不愿公开宣布不加税一样.
